1. Agreement to Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Solara Systems (“we,” “us,” or “our”) governing your access to and use of solarasystems.xyz, our Discord bot, and our dashboard (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years of age to use our Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.
3. Accounts and Authentication
3.1 Account Creation
You may access the Service by authenticating through Discord OAuth (via Discord directly or through Clerk). By doing so, you authorize us to access certain Discord account information as described in our Privacy Policy.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.
3.3 Account Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct harmful to the Service or other users.
4. Subscriptions and Payments
4.1 Paid Plans
Certain features are available only through a paid subscription. By subscribing, you agree to pay all applicable fees as described on our pricing page.
4.2 Payment Processing
All payments are processed by Stripe, Inc. By providing payment information, you agree to Stripe’s terms of service and authorize us to charge your payment method on a recurring basis.
4.3 Billing Cycle
Subscriptions are billed in advance on a recurring basis (monthly or annually). You authorize us to charge your payment method automatically at each renewal period.
4.4 Refunds
All fees are non-refundable except as required by applicable law. If you believe you were charged in error, please contact us within 14 days of the charge.
4.5 Cancellation
You may cancel your subscription at any time via the dashboard. Cancellation takes effect at the end of the current billing period.
5. Discord Bot Usage
By adding our Discord bot to your server, you agree that:
- You have the authority and necessary permissions to add the bot to the server
- You will not use the bot to violate Discord’s Terms of Service or Community Guidelines
- You will not attempt to abuse, exploit, or reverse-engineer the bot
- We may collect and process server data as necessary to operate the bot, as described in our Privacy Policy
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose
- Attempt to gain unauthorized access to any part of the Service
- Transmit malicious code, spam, or harmful content
- Reverse-engineer, decompile, or disassemble any part of the Service
- Resell or redistribute the Service without our express written permission
- Impersonate any person or entity
- Interfere with or disrupt the integrity or performance of the Service
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Solara Systems. Our name, logos, and all related marks are trademarks of Solara Systems. You may not use any of our intellectual property without prior written consent.
You retain ownership of any content you submit through the Service, but grant us a non-exclusive, worldwide, royalty-free license to use and process that content as necessary to operate the Service.
8. Third-Party Services
The Service integrates with third-party platforms including Discord, Stripe, and Clerk. Your use of those platforms is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
9. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. SOLARA SYSTEMS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOLARA SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.
11. Indemnification
You agree to defend, indemnify, and hold harmless Solara Systems and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Modifications
We reserve the right to modify or discontinue the Service at any time without notice. We may also update these Terms periodically. Continued use of the Service after changes become effective constitutes acceptance.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or, where not permitted, in a court of competent jurisdiction.
